We first met Agatha Mba in 2010, when she came to us for help with her application for Indefinite Leave to Remain in the UK in rather difficult circumstances. That application was successful, and Agatha was able to put an abusive marriage behind her, and get on with her life, but she could never forget the children she had left behind in Nigeria, with her first husband.

Agatha had been denied access to her children for many years, but then, in a change of mood as unexpected as it was welcome, Stephanie’s father allowed her to come on a visit to the UK.  When Stephanie told her mother about how she was mistreated at home by her stepmother, Agatha instructed us to make an application for Stephanie to remain in the UK with her.

As Stephanie had been living with her father, we couldn’t argue that Agatha had had sole responsibility for her, so we had to rely on ‘serious and compelling circumstances’ – always the most difficult to prove.  We suggested a DNA test, to get over any allegation that they were not mother and daughter, and advised Agatha on what documents she needed to get together to support her case.  We wrote very detailed representations, setting out all the details of what Stephanie had been going through, and making legal and human rights arguments in support of Stephanie’s application.

We were almost as delighted as Agatha and Stephanie when Stephanie’s application was successful!  She now has Indefinite Leave to Remain in the UK, and is studying at university.
