Tony is an Australian citizen. He originally had Indefinite Leave to Remain in the UK because his wife Lisa is a British citizen, but the couple moved to Australia in the early 1990s, and lived there until 2015, when they decided to return to the UK.
Tony knew, of course, that he no longer had Indefinite Leave to Remain – that’s lost if you live outside the UK for two years – but he didn’t realise just how complicated the whole process now is, and so he arrived in the UK as a visitor, thinking that he could apply from here. He was disappointed, naturally, when we told him that he needed to return to Australia to make the application – it is a long way to travel! – but accepted our advice when we said that it was the quickest, simplest and least stressful way to get what he wanted.
