John Paul’s application to come to the UK as the spouse of Ruth Carroll, a British citizen living in Grimsby, was refused because the Entry Clearance Officer in Gambia was not satisfied that they were legally married, and because Ruth made use of an authorised overdraft.
The original marriage certificate had been submitted with the application, but the Entry Clearance Officer was not satisfied that it was an authentic document. With the appeal we enclosed a letter from the pastor who had performed the ceremony, confirming that they were legally married. We also pointed out that use of an authorised overdraft does not necessarily imply that a person is not able to meet their financial obligations.
The Entry Clearance Officer accepted the evidence and the arguments that we put forward with the appeal, and called John Paul in to the Visa Application Centre to issue him with a visa without the matter needing to go before an Immigration Judge. The couple now live together in the UK, with their son, Alfie.
